Instrumental License Terms

When you download an instrumental license from bendsoundwaves.com you will be presented with a contract that lists out our working agreement. I've attached examples of these documents below so that you can better understand the process.

More important however is understanding the difference between exclusive and non-exclusive licenses in our work.

Exclusive licenses

Exclusive licenses give you the option to pay a premium to secure totally unlimited rights to an instrumental and also take it off the market. Please note that it will take up to 48 hours for us to manually remove the option to lease said instrumental from our website. Still, once your purchase has been made, you have effectively secured your exclusive rights to that instrumental.

While some may have purchased a non-exclusive license to that instrumental (which you can see the terms for below), once the exclusive has been purchased, the instrumental will no longer be available for any further licensing. This is best if you are creating an album that you want to ensure will have it's own unique instrumentals.

When you purchase your exclusive license, we enter into a legal agreement as joint songwriters (see an example below). When it comes to your Master Recording royalties, which are those paid through your distributor, you and your label/team will retain 95% of the "Sound Recording" Copyright.

As joint songwriters, our default terms are 50/50 for the "Composition" Copyright. However, if there are more people on the song you may opt for Nashville (equal) splits. Or if you feel that this does not accurately reflect the composition of the song, please email legal@bendsoundwaves.com and we are always happy to find an agreement that works for you.

Of course one major benefit of exclusive licensing is absolutely unlimited clearance for every use of the instrumental. From radio to live shows to streaming an exclusive license allows you to exploit the instrumental everywhere!

 

Leases

Leases are a more affordable option that allows you to pay less money up front while allowing other people to still buy the instrumental. Our goal with Leases is just as much to make hit records as it is with Exclusives. So, we aim to provide one Lease option with very generous limits in the hopes that those who buy Leases are so successful they will find they then need Exclusives.

When you buy a Lease you will be cleared for up to 15,000,000 streams or 100,000 sales or a combination thereof under the formula (150 streams = 1 sale). You are also cleared for 1 music video with up to 500,000 streams. Once you hit these limits (or are getting close), you will likely be automatically cleared for further numbers. You are also cleared for distribution to two radio stations.

The limits are in place simply to necessitate a check-in. Because substantial revenue will have been generated by the time these limits are reached, it is important to ensure that royalties are being handled per the terms of the initial agreement.

Which License is Right for Your Situation?

This is really a pretty simple question to answer. If you are signed to a major label I recommend buying the Exclusive License as soon as possible. Otherwise, if you are independent I recommend starting with a Lease.

Once you start making substantial money with the Lease, it is a good idea to then upgrade to the Exclusive License as soon as possible to ensure that you are cleared beyond the 15,000,000 streams limit and can get the beat taken off the market.
